TERMS OF SERVICE

1. AGREEMENT TO TERMS

These Terms of Service ("Terms") govern your access to and use of CryptoOrbit ("the Service", "the App"). By creating an account or using the Service, you agree to these Terms. If you don't agree, you may not use the Service.

These Terms form a legally binding agreement between you and the operator of CryptoOrbit (Nina Valenčak; "we", "us", "our").

2. ELIGIBILITY

To use CryptoOrbit, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding contract
• Provide accurate registration information
• Verify your email address before accessing the app
• Not be barred from using the Service under applicable law

3. ACCOUNT CREATION

3.1 Registration Required

You must create an account to use CryptoOrbit. During registration, you provide:

• A valid email address (subject to verification)
• A password (minimum 10 characters, with strength validation)
• Optional: a display name or nickname
• Acceptance of these Terms and our Privacy Policy
• Optional: consent to receive marketing communications

3.2 Email Verification

You must verify your email address by clicking the verification link sent to you upon registration. You cannot access the app's features until your email is verified.

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities under your account
• Notifying us immediately of any unauthorized use

We are not liable for losses caused by your failure to protect your account credentials.

3.4 One Account Per User

You may not create multiple accounts. Each user is permitted one account.

4. ACCEPTABLE USE

You agree to use CryptoOrbit only for lawful purposes. You must NOT:

• Use the Service for any illegal activity
• Attempt to hack, reverse-engineer, or disrupt the Service
• Use bots, scrapers, or automated tools to access the Service
• Impersonate others or provide false information
• Resell or commercialize the Service without permission
• Upload malicious code or attempt to introduce viruses
• Bypass our security measures or rate limits
• Use the Service to provide financial advice to others

5. THE SERVICE

5.1 What CryptoOrbit Provides

CryptoOrbit is an educational tool offering:

• Scenario Simulator — Bull/Bear/Realistic crypto investment scenarios
• DCA Calculator — Dollar-Cost Averaging analysis for 1000+ cryptocurrencies
• Portfolio Simulator — Multi-coin portfolio modeling
• "If I Bought" History — Historical performance analysis
• Save Scenarios — Cross-device synchronization of saved scenarios

5.2 Free Service

The Service is currently provided free of charge. We reserve the right to introduce premium features in the future, with prior notice to users.

5.3 Service Availability

We strive for high availability but do NOT guarantee uninterrupted service. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues
• Third-party service outages (e.g., CoinGecko, Supabase)
• Force majeure events

6. NOT FINANCIAL ADVICE

The calculations, projections, and scenarios provided by CryptoOrbit are:

• Based on user-provided inputs and assumptions
• Hypothetical and illustrative only
• Subject to high error margins due to crypto market volatility
• NOT predictions or guarantees of future performance

You acknowledge that:

• Cryptocurrency investments carry significant risk, including total loss
• Past performance does not predict future results
• You are solely responsible for your investment decisions
• You should always do your own research (DYOR)
• You should consult a qualified financial advisor before investing

7. CRYPTOCURRENCY DATA

Cryptocurrency prices and historical data are provided by third-party APIs (e.g., CoinGecko). We:

• Do not guarantee the accuracy or timeliness of data
• Are not responsible for data errors or delays
• May change data sources without notice

8. INTELLECTUAL PROPERTY

8.1 Our Property

CryptoOrbit (including its name, logo, design, code, and content) is our property and protected by copyright and trademark laws.

8.2 Your Content

You retain ownership of the data you create using the Service (e.g., saved scenarios). You grant us a limited license to store and process this data solely for providing the Service to you.

8.3 Restrictions

You may not:

• Copy, modify, or distribute our intellectual property
• Use our branding without permission
• Create derivative works of the Service

9. PRIVACY AND DATA PROTECTION

Our use of your personal data is governed by our Privacy Policy. By using CryptoOrbit, you also agree to the practices described in our Privacy Policy.

Your GDPR rights (Export, Delete, Withdraw consent, etc.) are accessible directly from your Account Settings page.

10. ACCOUNT TERMINATION

10.1 Termination by You

You can delete your account at any time via Account Settings → Danger Zone → Delete Account. This will:

• Permanently delete your account
• Delete all your saved scenarios
• Remove your data from our active databases (within 30 days)
• Cannot be undone

10.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the Service or its features
• Pose a security risk

We will notify you of termination via email when reasonably possible.

10.3 Effect of Termination

Upon termination:

• Your access to the Service ends immediately
• Your data is deleted as described in our Privacy Policy
• Sections 6, 11, 12, 13, 14, 15 survive termination

11. DISCLAIMERS

We do NOT warrant that:

• The Service will be error-free or uninterrupted
• Calculations or projections will be accurate
• Cryptocurrency data will be timely or correct
• Any content meets your specific requirements

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• We are NOT liable for any indirect, incidental, consequential, special, or punitive damages
• We are NOT liable for losses arising from your reliance on calculations or projections
• We are NOT liable for cryptocurrency investment losses, regardless of cause
• Our total liability shall not exceed €50 (fifty euros) or the amount you paid us in the past 12 months, whichever is greater

Some jurisdictions do not allow the exclusion of certain warranties or liabilities. In such cases, our liability is limited to the maximum extent permitted by applicable law.

13. INDEMNIFICATION

You agree to indemnify and hold harmless CryptoOrbit and its operator from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your investment decisions based on app data

14. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Slovenia, EU, without regard to conflict of law principles.

Any disputes shall be resolved:

• First, through good-faith negotiation
• If unresolved, before the competent courts of Slovenia

EU consumers retain rights under their local consumer protection laws and may bring proceedings in their country of residence.

15. CHANGES TO TERMS

We may update these Terms periodically. Significant changes will be communicated via:

• Email notification (to all account holders)
• Notice in the app upon your next login
• Updated "Last updated" date at the top of this page

Continued use of the Service after changes constitutes acceptance of the updated Terms. If you don't agree, you should stop using the Service and delete your account.

16. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
